I'm so confused

Talk, talk ... in today's Daily News is another story about the landfill.

(Ward 5 City Councillor) Derrivan said New Ventures isn't going to sign a deal with the state "unless they get approval from the city" to increase the volume. Derrivan also said there is a "real possibility" that if the city denies the proposal, the DEP could trump the city's authority and let the plan go through.

"They could supersede us," he said. "That is a reality and that is a fear. That is a real possibility."

New Ventures is in secret negotiations with the state to facilitate the swift capping and closure of the landfill. The city is not privy to these negotiations.

Well, if DEP can supersede a resounding "no" vote from the City Council, why not just stand on principle and vote "no?"

As I believe Larry McCavitt pointed out, the letter offering to let the city "off the hook" under 21E only does so partially anyway.

Maybe I'm too tired. I'm looking forward to the analyses of my fellow bloggers. Guys?

OK. here's my stupid wild arse guess......

The DEP can issue a superseding order of conditions and force us to take more volume than the HCA, but they can't make us take 70 truck loads a day.

I wonder if the DEP has as much involvement, per capita, in any other part of the state.

But (back to topic) one is dependent on the other, to close the stupid arse landfill by Dec. 31.

Do you think the state should be in secret negotiations with contractors to circumvent the well-being of residents of one of its cities? This landfill owner has made millions of this state, and from what I understand, he lives in NH!

What is your source that Billy Thibeault lives in New Hampshire? Public records indicate Lynnfield.

Of course, we're not being told the whole story. Our Councilors should be not be hiding anything. It seems to me we're being asked to give up something to get the guy to obey the law. Does that make sense?

I think the city should not agree to more trucks. If a state agency forces us to accept them, we should set a goal of 10-20 tickets per day. There is no way that many trucks can not violate a few traffic laws.

I think delay is good. The guy must have a contract to haul that stuff away from somewhere. Probably, if he has no where to put it, he'll have to pay penalties.

Ari, This from the Everett Average Citizen forum:

So basically, we would be getting pushed out of the city that (I for one) grew up in and have family and friends here from a rich non-compliant man that sits pretty in NH while he inflicts suffering on others and does absolutely 0 about it. You would think with all the money he spends in court and campaign contributions, he would give Newburyport and Everett some relief.
