Houston, we have a problem ...

Here is my latest story about the landfill - hot off the presses.

In it you can see that, at least from Ward 5 Councillor Brian Derrivan's take on last Monday's meeting with the DEP and Attorney General's office, the state seems to be trying to wash its hands of the matter.

And now, apparently, the state is lumping Newburyport and Everett together as one issue (none of this is detailed because of "legal issues," as Jack Morris put it).

Who knows what will happen? If we lose the Host Community Agreement, the city may lose almost all the power it has ... almost certainly this is leading towards litigation between the city and someone (although I think Moak will do almost anything to try and avoid that).

I talked with City Councillor-at-Large Barry Connell after the story had been filed (I called him about another issue), and he offered up his long-held perspective - that the city should have called the DEP up on the carpet way back when.

"We should make it more uncomfortable for them to ignore politics than to ignore (the issue)," Connell said, after something about giving "the DEP a black eye."

I recently watched video of the 2006 meeting where Matthew Ireland from the AG's office and Dick Chalpin from DEP told people gathered in City Hall that the state would take over the landfill if New Ventures failed to live up to its end of the bargain.

A few weeks ago now, I asked the press rep for the AG's office if all these antics playing out in YouTube videos and the back and forth with Everett and New Ventures were having an adverse effect on settling the landfill debacle, and of course they declined to comment.

Now I guess we know the answer.

PLEASE- Have your own council and a reporter at these hearings. DO NOT rely on the AG or the DEP.

They are going to sugar coat this trial. I would say legal representation for both the City of Newburyport and the AD HOC Committee since it is a binding agreement.

The attorneys for Newburyport must point out that Wood Waste has been a junk yard since the cease and desist. His materials have been piling up......just siting there waiting for the landfill to open. It's also a known fact that he is a campaign supporter to the Mayor DeMaria and friend. If Nylen says it's not relevant, it certainly is! That is the reason he has been allowed for so long to stay open and the Mayor NOT abiding by the wishes of the people and his Alderman. This has been an issue since the cease and desist in March 2008. Everett has pleading and begged the Mayor to do something and he blatantly refused.

For these issues it would be relevant in court. You should view the tapes of the city council meetings when Wood Waste was on the agenda. All the yelling that the Mayor did and all the defense to the business owner. These should be court record and the lies from the City Solicitor too. It proves the City of Everett and their building department (zoning violations) have not been doing their jobs and following the laws.

Hmmm. And all I have to say is, who is this Jack Morris? And have you pointed out to him the necessity of his support of the Tigers?

Sarah, no ... I was going to, just as I did Jack Morris, the new editor of North Shore Magazine ... who laughed and said he gets that a lot. I was kind of surprised that he gets that a lot, out here.
